Heater LLC ("Heater," "we," "us," or "our") operates the Preflop Wizard mobile application, also distributed as "GTO Preflop Wizard: Poker AI," on the Apple App Store and Google Play, together with this website (collectively, the "Service").

This Privacy Policy explains what information we collect when you use the Service, how we use and share it, and the rights and choices you have. By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy.

Information We Collect

Information You Provide

Preflop Wizard does not require you to create an account. If you contact us for support, we receive the information you choose to send us, such as your email address and the contents of your message.

Information Collected Automatically

When you use the Service, we and our service providers automatically collect certain information from your device ("Usage Data"), including:

  • Device information, such as device model, operating system and version, language, and region
  • App identifiers and device identifiers (for example, an app-instance identifier or, where you have permitted it, an advertising identifier)
  • IP address and approximate (coarse) location derived from it
  • In-app activity, such as screens viewed, features used, training sessions completed, session length, and crash and performance diagnostics

Purchase Information

Subscriptions and in-app purchases are processed by Apple (App Store) or Google (Google Play). We do not collect or store your payment card details. We may receive non-identifying transaction information from the app stores, such as the product purchased, purchase date, and subscription status, in order to provide you with the features you purchased and to handle billing issues and refund requests.

How We Use Information

We use the information we collect to:

  • Provide, maintain, and operate the Service
  • Verify subscriptions and deliver purchased features
  • Understand how the Service is used so we can improve it
  • Detect, prevent, and fix technical issues, crashes, and abuse
  • Measure the performance of our advertising campaigns
  • Provide customer support and respond to your requests
  • Comply with legal obligations and enforce our Terms of Service

Legal Bases for Processing (EEA, UK, and Switzerland)

If you are located in the European Economic Area, the United Kingdom, or Switzerland, we process your personal data on the following legal bases:

  • Performance of a contract — to provide the Service and features you have purchased
  • Legitimate interests — to improve the Service, secure it, and measure advertising, where those interests are not overridden by your rights
  • Consent — where required, for example for the use of advertising identifiers or tracking; you may withdraw consent at any time through your device settings
  • Legal obligation — where processing is necessary to comply with applicable law

How We Share Information

We do not sell your personal information. We share information only with:

  • Service providers that help us operate the Service (such as analytics, crash reporting, and hosting providers). They may access information only to perform services on our behalf and are obligated not to use it for other purposes.
  • App store operators (Apple and Google), for example to resolve billing issues. If you request a refund from Apple, we may share information about your usage of purchased content with Apple to help it evaluate the request, consistent with Apple's policies.
  • Advertising and attribution partners, in aggregated or device-level form as permitted by your device settings, to measure the effectiveness of our advertising.
  • Authorities or other parties where required by law — to comply with a legal obligation, protect our rights or property, investigate possible wrongdoing in connection with the Service, or protect the safety of users or the public.
  • A successor entity in connection with a merger, acquisition, or sale of all or part of our business, in which case this Privacy Policy will continue to apply to your information.

Analytics

We use Google Firebase (including Google Analytics for Firebase and Crashlytics) to understand usage of the Service and to diagnose crashes. Firebase is provided by Google LLC. You may limit certain collection through your device settings, such as resetting or disabling your advertising identifier (iOS: Settings → Privacy & Security → Tracking; Android: Settings → Google → Ads).

Data Retention

We retain personal data only for as long as necessary for the purposes described in this Privacy Policy. Analytics data is retained for a limited period as configured with our analytics providers, after which it is deleted or aggregated. Support correspondence is retained for as long as needed to resolve your request and for a reasonable period afterward. We may retain information longer where required by law, or in aggregated, de-identified form.

International Data Transfers

We are based in the United States, and information we collect is processed and stored in the United States and in other countries where our service providers operate. These countries may have data protection laws that differ from those of your jurisdiction. Where required, we rely on appropriate safeguards for international transfers, such as standard contractual clauses implemented by our service providers.

Your Rights and Choices

Depending on where you live, you may have some or all of the following rights:

  • Access — request a copy of the personal data we hold about you
  • Correction — request that we correct inaccurate personal data
  • Deletion — request that we delete your personal data
  • Portability — request your data in a portable, machine-readable format
  • Objection and restriction — object to or ask us to restrict certain processing
  • Withdraw consent — where processing is based on consent, withdraw it at any time

California Residents

If you are a California resident, the California Consumer Privacy Act (CCPA, as amended by the CPRA) gives you the rights to know, correct, and delete personal information we have collected about you, and to opt out of the "sale" or "sharing" of personal information. We do not sell personal information for money. To the extent that the use of advertising and analytics identifiers is considered "sharing" under California law, you can opt out by disabling tracking for the app in your device settings, or by contacting us at the email above.

EEA, UK, and Swiss Residents

You also have the right to lodge a complaint with your local data protection supervisory authority if you believe our processing of your personal data violates applicable law.

Security of Data

We use commercially reasonable technical and organizational measures to protect your information. However, no method of transmission over the Internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security.

Children's Privacy

The Service is intended for users 18 years of age and older and is not directed to children. We do not knowingly collect personal information from anyone under 18. If you are a parent or guardian and believe your child has provided us with personal information, please contact us at binkpokerapp@gmail.com and we will delete that information.

The Service may contain links to sites we do not operate. We have no control over, and assume no responsibility for, the content or privacy practices of any third-party sites or services. We advise you to review the privacy policy of every site you visit.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will post the updated policy on this page and update the effective date above. For material changes, we will provide additional notice, such as a prominent notice within the Service. Your continued use of the Service after changes become effective constitutes acceptance of the updated policy.
